dat.form Terms of Use

1. Application of these Terms
These Terms govern the use of the dat.form mobile application (the App). The App is provided by Datspire, a sole trader business operating in Queensland, Australia (Datspire, we, us or our).
2. Licence and permitted use
Subject to these Terms, you may use the App for your personal, non-commercial wellness records.
You must not:
- misuse the App or interfere with its operation;
- bypass or attempt to bypass a security control; or
- use the App in a way that infringes another person's rights or contravenes applicable law.
3. Your responsibilities
You are responsible for:
- the accuracy of information you enter;
- securing your device and access to the App;
- deciding whether and with whom to share information; and
- retaining any separately shared records you wish to keep.
4. Recommended audience
The recommended audience is people aged 16 and over. This is not a mandatory eligibility condition, and the current App does not verify age.
5. General-wellness information
The App provides personal records, estimates, trends and general-wellness information. It does not diagnose, treat or provide professional healthcare advice and does not replace advice from a qualified health professional.
Results may be incomplete, approximate or unsuitable for your circumstances. You must not use the App for emergencies or as the sole basis for decisions concerning medical care, nutrition, exercise, medication, mental health or an eating disorder. Read the Health Information Disclaimer before relying on a result.
6. Local records and sharing
The current App stores records locally on your device. It does not create a Datspire account or store a server copy. Records may be lost through device loss, deletion within the App, use of Settings > Erase all data, or storage failure. Making your own backup is the way to guard against that loss, and whether to make one is your decision.
The App provides a manual backup, export and restore feature that you operate yourself. The exported archive is encrypted with a passphrase you choose, and Datspire neither holds that passphrase nor can recover it or open the archive. You hand the exported file to your operating system share sheet and choose its destination; Datspire does not receive it. Restoring an archive replaces the record on your device once you confirm, and a backup you have already saved is not removed by deleting data in the App.
If you separately share content using a feature available in the App, you choose the receiving application, service or person. Datspire does not control the recipient or copies retained outside the App.
7. Payments and advertising
Purchases cannot be made and no charges arise in the current App. The current App does not display advertising, offer an in-app purchase or provide a paid entitlement.
If a future version offers a purchase, subscription or advertising, the applicable price, billing terms, restoration arrangements and disclosures will be provided before that feature is enabled. A paid entitlement must not be assumed to transfer between stores unless the applicable offer expressly states that it does.
8. Intellectual property
Except for information you enter and third-party materials, the App and its original content are owned by or licensed to Datspire and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of that intellectual property to you.
Open-source components remain subject to their applicable licences. Release-specific components and licence terms are identified in the Open Source Notices for that release.
9. Availability and changes to the App
Datspire may maintain, correct, modify or discontinue App features, subject to applicable law. Datspire does not promise uninterrupted availability or that every estimate will be free from error.
10. Consumer rights
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified, including any applicable right under the Australian Consumer Law.
11. Changes to these Terms
Datspire may amend these Terms to reflect changes to the App or applicable requirements. Each published version will state its effective date. Material changes will be notified through an appropriate channel and will not take effect before the stated effective date.
